These terms apply to your use of MyOps, software owned and operated by rTheory LLC, 326 W Kalamazoo Ave, Kalamazoo, MI 49007. By creating an account or signing in, you agree to these terms. If you do not agree, please do not use MyOps.
1. MyOps is in beta
MyOps is currently in beta and under active development. Features may change, move or be removed, and you may occasionally encounter errors or unexpected behavior. Please keep your own copies of anything that is important or difficult to replace.
2. Provided as is
During the beta, MyOps is provided “as is” and “as available,” without express or implied warranties. This includes implied warranties of fitness for a particular purpose, merchantability, accuracy and uninterrupted availability.
3. No service levels
The beta does not include guaranteed service levels for uptime, availability, response times, support, backups or data retention. MyOps may occasionally be unavailable, and data could be lost or corrupted as the platform continues to develop.
4. Your use of MyOps
You decide what information to put into MyOps and how you use the platform. You remain responsible for your own records, your clients’ expectations, and decisions you make based on information stored or managed through MyOps.
To the fullest extent permitted by law, rTheory LLC is not liable for loss or damage arising from your use of MyOps, including lost work, data, revenue or business, whether direct or indirect.
5. Who owns what
rTheory LLC owns MyOps, including its software, design, interfaces, name and other elements that make up the platform. Your access during the beta gives you permission to use MyOps, but does not transfer ownership or other rights in the platform. You may not copy, resell, rent, reverse engineer or use MyOps to build a competing product.
You retain ownership of the content you put into MyOps, including your tasks, files, client details and other information. You give rTheory LLC permission to store and process that content as needed to provide and operate MyOps for you.
6. Your workspace and beta access
You may invite your own team members, clients and partners into your workspace. These terms apply to everyone you add, and you are responsible for managing their access to MyOps.
Each person should use their own login rather than sharing account credentials. Because MyOps is still in beta, please keep access, screenshots and details about unreleased features within your workspace unless you have permission to share them more broadly.
7. Acceptable use
You agree not to:
- use MyOps for unlawful purposes or to store or send unlawful material;
- upload another person’s confidential or personal information unless you have the right to do so;
- upload malware or other material designed to damage or disrupt systems;
- attempt to access another workspace, account or part of MyOps that you have not been authorized to access;
- probe, scan, overload or intentionally interfere with MyOps or the systems it runs on;
- use MyOps to send unsolicited messages; or
- impersonate another person or misrepresent your relationship with a person or organization.
8. Your work and getting a copy of it
Your work in MyOps remains yours. You may ask us for a copy at any time, including if your access ends or the beta closes. We will make every reasonable effort to provide the content you created while using MyOps in a format that can be used elsewhere. Contact admin@rtheory.co and we will let you know what can be provided and the expected timing.
Because MyOps is still in development, we cannot guarantee that every piece of data will always be recoverable or exportable. For that reason, we recommend keeping your own copies of anything critical, as described in section 1.
9. Ending access
You may stop using MyOps at any time. rTheory LLC may also suspend or end access, including where these terms have been breached, and may conclude the beta program itself.
If we end your access, we will let you know, and the provisions in section 8 regarding your work and data will apply.
10. Changes to these terms
These terms may change as MyOps develops. If we make a significant change, we will let you know and ask you to accept the updated terms before continuing to use MyOps.
A change is considered significant if it affects your legal obligations or ours, the cost of MyOps, or how your data is stored or used.
11. Governing law
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute relating to these terms or MyOps will be handled by the applicable state or federal courts located in Michigan, and both you and rTheory LLC agree to that jurisdiction.
